App MyKeys Safe S Privacy Policy

SILCA S.p.a., registered office in Via Podgora 20, Vittorio Veneto (TV), email data.protection@silca.it, as Data Controller (hereinafter ‘SILCA’ or ‘Data Controller’), issues this privacy policy pursuant to European and Italian regulations concerning the protection of personal data, to illustrate its data processing method for purposes linked to the installation and use of the MyKeys Safe S Application (hereinafter ‘MyKeys Safe S’ APP). The Data Controller has appointed a Data Protection Officer (DPO), to whom interested parties can contact in writing at data.protection@silca.it.

Purpose of processing and legal principle

SILCA will process your data for the following purposes:

  1. SERVICE PURPOSES
  • To download and activate the MyKeys Safe S APP;
  • To diagnose problems in the MyKeys Safe S APP;
  • To investigate and reply to any comments or complaints received from users;
  • To help protect users by detecting, preventing or otherwise dealing with fraud, technical or security problems and hacking;
  • To exercise the Data Controller’s rights.

With regard to these ‘Service Purposes’, the legal principle on which processing is based is the need to ensure installation and correct operation of the APP requested, or to comply with a legal obligation.

  1. PROMOTIONAL PURPOSES
  • To send promotional and informative material (e.g. newsletters) regarding initiatives, promotions and events organised by SILCA or in which SILCA takes part.

With regard to these ‘Promotional Purposes’, the legal principle is given consent, which may be withdrawn at any time.

Data storage duration

The Data Controller will process your data:

  1. FOR SERVICE PURPOSES

For the time strictly necessary to pursue the purposes, after which the data will be erased or made anonymous.

  1. FOR PROMOTIONAL PURPOSES

For 24 months from the last communication, unless consent is withdrawn earlier.

In any case, disinstalling the MyKeys Safe S APP will have the immediate effect of stopping the Data Controller’s collection of any further information. However, the Data Controller will store the data for the time needed to achieve the above-mentioned purposes, which will not exceed two years from elimination of the profile.

Provision of data and consequences of failing to provide data

Provision of data:

  1. FOR SERVICE PURPOSES

is necessary for installing and using the MyKeys Safe S APP and to comply with the obligations involved. Without the data the user cannot download the MyKeys Safe S APP.

  1. FOR PROMOTIONAL PURPOSES

is optional and refusing to provide the data and give consent will bar the Data Controller from carrying out the activities in question, but will not prevent the installation or use of the MyKeys Safe S APP.

Categories of recipients

Exclusively for the above-mentioned purposes, SILCA may communicate your data to the following categories of subjects: in-house data processors authorised in accordance with their duties; companies in charge of creating promotions and/or commercial communication; carriers and/or forwarders; companies in charge of sending advertising and promotional material; companies who manage and store SILCA’s archives (electronic and/or paper); public and private bodies in the course of inspections and checks; companies, consultants and professionals who work on behalf of SILCA to pursue the above-mentioned purposes.

If the Data Controller outsources the processing of your data to these recipients on its behalf, they will be appointed as data processors by a special agreement or other legal deed.

Transfer of data to third party countries and/or international organisations

Your personal data will NOT be transferred to third party countries outside the EU.

Data subjects’ rights

You have the right to require the Data Controller to grant you access to your personal data: to rectify them if incorrect; to erase them or to restrict processing; and to receive the personal data concerning you and provided by you.

To exercise your rights, write to the Data Controller at data.protection@silca.it.

You also have the right to lodge a complaint with the competent supervisory authority (Garante per la protezione dei dati personali www.garanteprivacy.it).

Declaración de confidencialidad de la aplicación MYKEYS Safe S

SILCA S.p.a., con domicilio social en Via Podgora 20, Vittorio Veneto (TV), correo electrónico data.protection@silca.it, en calidad de Responsable del Tratamiento (en adelante «SILCA» o «Responsable del Tratamiento»), emite la presente declaración de confidencialidad de conformidad con la normativa europea e italiana relativa a la protección de los datos personales, para ilustrar su método de tratamiento de datos para fines relacionados con la instalación y el uso de la aplicación MyKeys Safe S (en adelante aplicación «MyKeys Safe S»). El Responsable del Tratamiento ha nombrado un Delegado de Protección de Datos (DPD), al que los interesados pueden dirigirse por escrito a data.protection@silca.it.

Finalidad del tratamiento y base jurídica

SILCA tratará sus datos para los siguientes fines:

  1. FINES DE SERVICIO
  • Descargar y activar la aplicación MyKeys Safe S;
  • Diagnosticar problemas en la aplicación MyKeys Safe S;
  • Investigar y responder a cualquier comentario o queja que se reciba de los usuarios;
  • Ayudar a proteger a los usuarios detectando, previniendo o tratando de otra manera el fraude, los problemas técnicos o de seguridad y la piratería informática;
  • Ejercer los derechos del Responsable del Tratamiento.

Con respecto a estos «Fines de Servicio», la base jurídica en la que se basa el tratamiento es la necesidad de asegurar la instalación y el correcto funcionamiento de la aplicación solicitada, o de cumplir con una obligación legal.

  1. FINES PROMOCIONALES
  • Enviar material promocional e informativo (por ejemplo, boletines de noticias) sobre iniciativas, promociones y eventos organizados por SILCA o en los que SILCA participe.

Con respecto a estos «Fines Promocionales», la base jurídica es el consentimiento dado, que puede ser retirado en cualquier momento.

Duración de la conservación de los datos

El Responsable del Tratamiento tratará sus datos:

  1. CON FINES DE SERVICIO

Durante el tiempo estrictamente necesario para perseguir los fines, tras lo cual los datos serán borrados o convertidos en anónimos.

  1. CON FINES PROMOCIONALES

o 24 meses desde la última comunicación, a menos que el consentimiento sea retirado antes.

En cualquier caso, la desinstalación de la aplicación MyKeys Safe S tendrá el efecto inmediato de detener la recogida de cualquier información adicional por parte del Responsable del Tratamiento. Sin embargo, el Responsable del Tratamiento conservará los datos durante el tiempo necesario para lograr los fines mencionados, que no excederá de dos años a partir de la eliminación del perfil.

Suministro de datos y consecuencias de la falta de suministro de datos

Suministro de datos:

  1. CON FINES DE SERVICIO

es necesario para instalar y utilizar la aplicación MyKeys Safe S y para cumplir con las obligaciones que conlleva. Sin los datos, el usuario no puede descargar la aplicación MyKeys Safe S.

  1. CON FINES PROMOCIONALES

es opcional y negarse a proporcionar los datos y dar el consentimiento impedirá al Responsable del Tratamiento llevar a cabo las actividades en cuestión, pero no impedirá la instalación o el uso de la aplicación MyKeys Safe S.

Categorías de destinatarios

Exclusivamente para las finalidades mencionadas, SILCA podrá comunicar sus datos a las siguientes categorías de sujetos: encargados internos del tratamiento de los datos autorizados en virtud de sus funciones; empresas encargadas de la realización de promociones o comunicaciones comerciales; transportistas o expedidores; empresas encargadas del envío de material publicitario y promocional; empresas que gestionan y almacenan los archivos de SILCA (electrónicos o en papel); y organismos públicos y privados en el curso de inspecciones y controles; empresas, asesores y profesionales que trabajan por cuenta de SILCA para la consecución de las finalidades mencionadas.

Si el Responsable del Tratamiento subcontrata el tratamiento de sus datos a estos destinatarios en su nombre, estos serán designados como encargados del tratamiento mediante un acuerdo especial u otro acto jurídico.

Transferencia de datos a terceros países u organizaciones internacionales

Sus datos personales NO serán transferidos a terceros países fuera de la UE.

Derechos de los interesados

Tiene derecho a exigir al responsable del tratamiento que le conceda acceso a sus datos personales: a rectificarlos si son incorrectos; a borrarlos o a limitar su tratamiento; así como a recibir los datos personales que le conciernen y que usted ha facilitado.

Para ejercer sus derechos, escriba al Responsable del Tratamiento a data.protection@silca.it.

También tiene derecho a presentar una reclamación ante la autoridad de control competente (en Italia, Garante per la protezione dei dati personali - www.garanteprivacy.it).
